    UNPACKING INSTRUCTIONS

    Place the mattress on the bed base. Remove the packaging tape without using sharp or cutting tools. Unfold the mattress and allow it to recover its original volume. The optimal time for the mattress to fully regain its volume and properties is 24 hours, during which it should not be used. Residual manufacturing odours may be noticed for a few days after opening and removing the packaging. These are harmless to human health. Once unpacked, the mattress cannot be rolled up again.

    INSTRUCTIONS FOR USE AND STORAGE

    Use the mattress on a bed base that matches the exact size of the mattress, to ensure proper air circulation and full body support. Do not use the mattress on a solid base, as this restricts moisture dissipation and may result in mould. Periodically rotating the mattress — head to foot and top to bottom — promotes better air circulation, prevents the accumulation of dust and moisture, and extends the life of the product, even beyond the warranty period. Do not allow liquids to penetrate the mattress. Use a mattress protector for maximum protection and hygiene.

    FULL WARRANTY CONDITIONS

    Art. 1 The Consumer Code under European Directive 1999/44/CE establishes a two-year legal warranty from the date of purchase.

    Art. 2 Matrax AD sets the warranty period for each product.

    Art. 3 Matrax AD sets the warranty period for the purchase from the date of acquisition, evidenced by the relevant purchase documents (invoice and/or fiscal receipt). The warranty is valid only if the customer has strictly followed the instructions for use and storage and the conditions stated on the warranty card.

    Art. 4 All claims relating to hidden manufacturing defects or deterioration of mattress quality not caused by ordinary use must be submitted to Matrax AD by completing the form at the following web address:

    Art. 5 In all cases, the warranty does not cover defects caused by: improper use of the mattress; use of force; repairs made by the customer or third parties; contamination and moisture; wear-related deformation of the textile (quilting and border stitching, torn fabric or handles, unstitched border, broken zip, border displacement, fabric stains, etc.).

    Art. 6 The mattress must be opened within one month of receipt. An unpacked mattress with an incorrect model or size, due to the customer's error, is not eligible for replacement.

    Art. 7 Matrax AD accepts product claims in the following cases:

    • Non-conformity with the declared trademark
    • Dimensional discrepancies exceeding a tolerance of +/- 2 cm in width, length, or thickness
    • Product defect identified within 3 days of purchase
    • Product defect identified during use within the warranty period, consisting of an irreversible elastic deformation of the core/foam exceeding 2 cm in thickness

    Art. 8 Where non-conformities or defects are identified after the second year and within the warranty period, Matrax AD offers the customer a mattress replacement, with the customer paying the difference between the value of the new mattress and the amount paid for the original mattress, minus accumulated depreciation proportional to the price, for each year of use. The replacement is carried out within 30 days of written confirmation by the customer of the proposed replacement.

    Art. 9 Replacement of the mattress within the warranty period does not extend the warranty term.

    Art. 10 Replacement of the mattress after the warranty period, or for a defect not covered by the warranty, is entirely at the customer's expense.

    Art. 11 When a defect is reported, Matrax AD reserves the right to send a representative to assess it.

    Art. 12 Matrax AD does not assume liability for recommendations regarding physical or health conditions.

    Art. 13 Articles 33–38 of the Consumer Goods Sales and Digital Content Act (CGSDC):

    Art. 33. (1) Where goods do not conform to the individual contractual requirements, the objective conformity requirements, or the installation requirements, the consumer has the right to:

    • lodge a complaint requesting the seller to bring the goods into conformity;
    • receive a proportionate reduction in price;
    • terminate the contract.

    In the cases referred to in paragraph 1(1), the consumer may choose between repair or replacement of the goods, unless this proves impossible or would entail disproportionate costs for the seller, taking into account all circumstances, including:

    • the value the goods would have if they were in conformity;
    • the significance of the non-conformity;
    • whether the alternative remedy could be provided without significant inconvenience to the consumer.

    The seller may refuse to bring the goods into conformity if repair and replacement are impossible or would entail disproportionate costs.

    The consumer is entitled to a proportionate reduction in price or to terminate the contract in the following cases:

    • the seller has not carried out repair or replacement;
    • a non-conformity reappears despite the seller's remedial action;
    • the non-conformity is so serious as to justify immediate price reduction or contract termination;
    • the seller has declared or it is clear from the circumstances that the seller will not bring the goods into conformity within a reasonable time.

    The consumer may not terminate the contract if the non-conformity is minor. The burden of proof as to whether the non-conformity is minor lies with the seller.

    The consumer is entitled to withhold payment of any remaining price until the seller fulfils its obligations.

    Art. 34. (1) Repair or replacement of the goods shall be carried out free of charge within a reasonable time from notification by the consumer. For goods other than those containing digital elements, the period is one month. Upon replacement, the seller collects the replaced goods at its own expense. The consumer does not owe payment for normal use of the replaced goods prior to replacement.

    Art. 35. The price reduction shall be proportionate to the difference between the value of the goods received and the value they would have had in conformity.

    Art. 36. (1) The consumer exercises the right to terminate the contract by declaration to the seller. Upon termination, the consumer returns the goods within 14 days. All return costs are borne by the seller. The seller refunds the price using the same payment method.

    Art. 37. (1) The consumer may exercise their rights within two years from delivery of the goods. This period is suspended during repair or replacement.

    Art. 38. A seller liable for non-conformity caused by the act or omission of a person at a prior stage of the commercial chain has the right to pursue a claim for damages against that person.

    In the event of goods non-conformity, the consumer has legal remedies against the seller at no cost, and the commercial warranty does not affect these consumer remedies.

    By completing the purchase, the customer accepts and agrees to these UNPACKING INSTRUCTIONS, INSTRUCTIONS FOR USE AND STORAGE, and WARRANTY CONDITIONS.

    A claim will only be accepted if the UNPACKING INSTRUCTIONS, INSTRUCTIONS FOR USE AND STORAGE, and WARRANTY CONDITIONS have been strictly followed.
